Important notice: this English version is provided for information purposes only. The only legally binding version is the French version ("Conditions Générales de Vente"). In case of any discrepancy, contradiction or difference in interpretation between the two versions, the French version shall prevail. LA SMOLE SASU is a French company governed by French law. Any contractual relationship between LA SMOLE and the Customer is governed by French law and subject to the exclusive jurisdiction of the French courts, subject to the mandatory provisions of the Customer's country of residence where applicable.
ARTICLE 1 - PREAMBLE AND SELLER IDENTIFICATION
These terms and conditions of sale (hereinafter the "Terms") govern all sales made on the website www.lasmole.com (hereinafter the "Site").
The Site is operated by LA SMOLE, a French société par actions simplifiée unipersonnelle (single-shareholder simplified joint-stock company) with share capital of 12,000 €, whose registered office is located at 30 Boulevard de Sébastopol, 75004 Paris, France, registered with the Paris Trade and Companies Register under number 993 644 301, represented by Ms. Daravy Ange, as President (hereinafter the "Seller").

Any Order placed on the Site implies full and unreserved acceptance of these Terms. The Customer is invited to read them carefully before placing any order.
ARTICLE 2 - DEFINITIONS
"Customer": any adult natural person or legal entity acting for purposes outside their commercial, industrial, craft or professional activity, placing an order on the Site.
"Order": any purchase of Product(s) made by the Customer on the Site, including Pre-orders.
"Pre-order": any order placed before the announced shipping date, under the conditions set out in Article 7.
"Product(s)": all items offered for sale on the Site (swimsuit tops, bottoms, one-piece swimsuits and accessories where applicable).
ARTICLE 3 - PRODUCTS
The Seller offers women's swimwear designed for small-bust body types. Products are presented with the greatest possible accuracy. However, photographs are not contractual: minor differences in colour or appearance may exist due to screen display variations.
Each Product is accompanied by a description detailing its essential characteristics within the meaning of article L.111-1 of the French Consumer Code (size, colour, textile composition).
ARTICLE 4 - PRICES
Prices are shown in euros, all taxes included (TTC), excluding shipping costs. Applicable shipping costs are communicated to the Customer before Order validation.
For Customers located outside mainland France, displayed prices are automatically converted into the Customer's local currency for information purposes. The amount actually charged may vary depending on the exchange rate applied by the Customer's bank.
The Seller reserves the right to change prices at any time. Products are invoiced based on the rates in force at the time of Order validation.
ARTICLE 5 - ORDER
The Customer selects the Product(s), adds them to the cart, checks the order summary, enters shipping and billing information, selects the delivery method, then proceeds to payment.
Payment validation constitutes acceptance of these Terms and final formation of the sale contract, subject to the right of withdrawal set out in Article 11.
A confirmation email is sent to the Customer after payment validation, summarising the essential elements of the Order (products, price, address and delivery method).
The Seller reserves the right to refuse or cancel any order in case of a prior unresolved dispute with the Customer, suspected fraud, or manifestly abnormal order.
ARTICLE 6 - PAYMENT
Payment is made online at Order validation, by one of the following means:
- Credit/debit card: Visa, Mastercard, American Express, Cartes Bancaires (CB)
- Digital wallets: Apple Pay, Shop Pay, PayPal
- Instalment payment: Klarna (subject to eligibility and Klarna's own terms)
- Cryptocurrencies: USDC (funds are converted and paid in euros to the Seller)
- Local payment methods (depending on Customer's country of residence): Bancontact (Belgium), BLIK (Poland), EPS (Austria), iDEAL / Wero (Netherlands), MobilePay, Przelewy24 (Poland)
The availability of certain payment methods depends on the Customer's country of residence and the eligibility conditions of each provider.
Payment is secured by Shopify Payments. The Customer's banking data is neither collected nor stored by the Seller.
The Order is only validated after effective confirmation of payment by the relevant bank or payment provider. In case of payment refusal, the Order is automatically cancelled.
ARTICLE 7 - PRE-ORDERS
The Seller may offer certain Products on pre-order. The mention "Pre-order" is clearly indicated on the relevant product page, along with the estimated shipping date.
By placing a Pre-order, the Customer accepts that the Product is not immediately available and that its shipping will take place on the estimated date.
For the launch of Collection 01, Pre-orders are open from 24 April 2026. First shipments will begin on 11 May 2026.
The Customer is charged at Pre-order validation.
In case of a shipping delay of more than seven (7) working days compared to the estimated date, the Customer will be informed by email and may request cancellation of their Pre-order and obtain a full refund within fourteen (14) days of their request.
The right of withdrawal set out in Article 11 applies to Pre-orders, with the withdrawal period running from the effective receipt of the Product.
ARTICLE 8 - PROMOTIONAL OFFERS AND DISCOUNT CODES
The Seller may occasionally offer promotional offers or discount codes, under the conditions and durations specified at the time of their communication.
Unless otherwise indicated, discount codes are: single-use, non-cumulative, applicable only on the Site, and neither refundable nor exchangeable for money.
Launch offer: a 10% discount is offered on the first fifty (50) orders, applied automatically or via the code HELLOLASMOLE, on a complete set (top + bottom) or on a one-piece swimsuit. Limited to one (1) use per customer per order.
In case of return of a Product that benefited from a discount, the refund will be calculated based on the price actually paid after the discount has been applied.
ARTICLE 9 - DELIVERY
9.1 Delivery zone
The Seller delivers to mainland France, to European Union countries, to the United Kingdom, to Switzerland and internationally. Products are shipped to the delivery address provided by the Customer at Order.
For deliveries outside the European Union, customs duties and local import taxes may apply. These costs remain entirely at the Customer's expense. The Seller shall in no case be liable for the amount of these taxes or for delays linked to customs formalities.
9.2 Shipping provider
Shipments are managed via the Sendcloud platform, a technical shipping provider ensuring the connection between the Seller and the carriers. Sendcloud is not the carrier and does not physically handle parcel transport.
9.3 Processing and shipping
Orders are prepared and shipped by the Seller within a maximum of forty-eight (48) working hours (Monday to Saturday morning included) following payment confirmation, excluding Pre-order periods and exceptional circumstances (stock shortage, order peak, force majeure).
The Seller commits to respecting this shipping deadline. Any shipping delay attributable to the Seller (beyond 48 working hours) will be notified to the Customer by email.
9.4 Carriers, lead times and rates
The Customer may choose between the available delivery methods depending on their geographical zone:

Delivery times shown are estimates running from the shipping date and do not constitute a contractual commitment of the Seller. They depend on the chosen carrier and destination.
The Seller shall not be liable for delivery delays attributable to the carrier, postal services, customs, or any event of force majeure.
9.5 Shipping costs
Shipping costs are communicated to the Customer before Order validation and depend on the chosen delivery method and destination. The rates above are indicative and may vary depending on parcel weight and destination.
9.6 Order tracking
A tracking number is sent by email to the Customer as soon as the parcel is shipped. The Customer can track the shipment directly with the carrier or via the Sendcloud tracking platform.
9.7 Delivery delay
In accordance with article L.216-1 of the French Consumer Code, if the Product is not delivered on the agreed date or, failing that, within thirty (30) days of the Order, the Customer may terminate the contract by registered letter with acknowledgment of receipt or in writing on any other durable medium, after having served the Seller formal notice to deliver within an additional reasonable period.
The Seller then refunds the Customer all sums paid within fourteen (14) days of contract termination.
Important clarification: the Seller is only responsible for meeting its shipping deadline (48 working hours). Delays occurring after the parcel has been handed over to the carrier are not attributable to the Seller.
9.8 Receipt and reservations
The Customer must check the condition of the parcel upon receipt. If an anomaly is identified (damaged or opened parcel, missing product), the Customer must:
- Make written reservations with the carrier at the time of delivery;
- Inform the Seller at hello@lasmole.com within three (3) working days of receipt, attaching photographs of the parcel and the Product.
Failing reservations within this period, the Product will be deemed compliant with the Order.
ARTICLE 10 - TRANSFER OF RISK
In accordance with article L.216-4 of the French Consumer Code, the transfer of risks of loss or damage to Products occurs when the Customer (or a third party designated by them) physically takes possession of the Product.
ARTICLE 11 - RIGHT OF WITHDRAWAL
11.1 Principle
In accordance with articles L.221-18 et seq. of the French Consumer Code, the Customer has a period of fourteen (14) calendar days from receipt of the Product to exercise their right of withdrawal, without having to justify a reason or pay a penalty.
11.2 Exercising the right of withdrawal
The Customer notifies their decision to withdraw by email to hello@lasmole.com, indicating their order number and the email address used for the purchase, or by completing the withdrawal form provided in the annex to these Terms.
The Seller acknowledges receipt of the request and communicates the return instructions and return address.
11.3 Hygiene-related exception, article L.221-28, 5° of the French Consumer Code
Due to the nature of the Products (swimwear), bikini bottoms and one-piece swimsuits are delivered with a hygienic protection sticker placed on the gusset.
Removing this sticker makes the Product definitively non-returnable and non-refundable, in accordance with article L.221-28, 5° of the French Consumer Code on unsealed goods that cannot be returned for health or hygiene reasons.
11.4 Restrictions during sales periods
During sales periods, no return for refund is accepted. Only exchanges are possible, under the conditions set out in Article 14. The 14-day legal right of withdrawal remains applicable under the conditions provided by law.
ARTICLE 12 - RETURN CONDITIONS
12.1 General principle, strictly limited returns
Returns for refund are only accepted in the following limitative cases. Outside these cases, no return will be processed, no refund will be granted and no claim will be admissible.
- Exercise of the right of withdrawal (Article 11), within 14 calendar days of Product receipt, without reason, subject to strict compliance with all the conditions of Article 12.3.
- Product not conforming to the Order, wrong item, wrong size sent by the Seller, or Product with a manufacturing defect that is observed and documented (with photographs).
- Product damaged upon receipt, subject to the Customer having made written reservations with the carrier and informed the Seller within the three (3) working-day period set out in Article 9.8.
For the avoidance of doubt: a change of mind, a sizing error by the Customer, the fact that the Product does not match the Customer's aesthetic expectations, or any other reason of personal preference do not constitute grounds for return for refund beyond the 14-day legal withdrawal period. An exchange may however be offered under the restrictive conditions of Article 14.
12.2 Return procedure, mandatory prior approval
Any return must be subject to prior written approval from the Seller. No parcel returned without such approval will be accepted or processed. The parcel will be refused or sent back to the Customer at their expense.
The Customer contacts the Seller at hello@lasmole.com indicating their order number, purchase email address and the reason for the return. The Seller then communicates the instructions and return address.
The Product must be returned within fourteen (14) days of the Seller's approval.
12.3 Mandatory return conditions, cumulative criteria
All of the following criteria are cumulative. Failure to comply with any single one of them leads to return refusal, without exception:
- The hygienic protection sticker must be intact and not peeled off (bikini bottoms and one-piece swimsuits). Any removal, even partial, makes the Product definitively non-returnable;
- The outer and inner tags must be intact, not cut and not detached;
- The Product must be unworn, unwashed, without stain, without odour (perfume, deodorant, sunscreen), without any trace of use whatsoever;
- The Product must be returned in its original pouch and shipping packaging, in good condition.
12.4 Try-on recommendation
The Seller recommends that the Customer try on swimsuits while keeping their underwear on and taking care not to remove the hygienic protection sticker. Failing that, and if the Product shows traces of use, the return will be refused.
12.5 Return refusal
Any return not complying with the above conditions will be refused. The Product will then be sent back to the Customer at their expense, without refund or credit.
12.6 Return costs, principle: at the Customer's expense
Return shipping costs are entirely at the Customer's expense, including in case of exercise of the right of withdrawal. Initial shipping costs are non-refundable (except in case of full Order return under the right of withdrawal, where standard shipping costs are refunded in accordance with article L.221-24 of the French Consumer Code).
The Seller recommends shipping with tracking and insurance. The Seller shall not be liable for the loss or damage of a parcel returned without tracking.
Single exception: in case of error attributable to the Seller (non-conforming product, sizing error by the Seller, confirmed manufacturing defect), return costs are covered by the Seller. A prepaid return label will then be provided to the Customer.
ARTICLE 13 - REFUND
The refund is issued within fourteen (14) days of receipt of the returned Product by the Seller and verification of its compliance with the conditions of Article 12. If the returned Product does not meet all the criteria of Article 12.3, no refund will be issued.
The refund is made using the same payment method used for the Order, unless the Customer expressly agrees to another method. It covers only the price of the returned Product(s).
ARTICLE 14 - EXCHANGES
The Customer may request an exchange (different size, different model) by contacting the Seller at hello@lasmole.com. Exchanges are subject to the same strict conditions as returns (Article 12) and to the availability of the desired Product.
Return and reshipping costs for the exchange are at the Customer's expense, except in case of error attributable to the Seller.
Exchange is the only accepted method during sales periods (except for the exercise of the legal right of withdrawal).
In case of exchange for a higher-priced Product, the Customer pays the difference. In case of exchange for a lower-priced Product, the difference is refunded to the Customer.
ARTICLE 15 - LEGAL WARRANTIES
15.1 Conformity warranty
In accordance with articles L.217-3 et seq. of the French Consumer Code, the Customer benefits from the legal conformity warranty for a period of two (2) years from Product delivery. In case of lack of conformity, the Customer may choose between repair and replacement of the Product, subject to the cost conditions provided by law.
15.2 Hidden defects warranty
The Customer benefits from the hidden defects warranty within the meaning of articles 1641 to 1649 of the French Civil Code. Action resulting from redhibitory defects must be brought within two (2) years of discovery of the defect.
ARTICLE 16 - LIABILITY
The Seller is only bound by an obligation of means regarding the delivery of Products after handover to the carrier.
The Seller's liability is excluded in case of:
- Force majeure within the meaning of article 1218 of the French Civil Code;
- Delay or loss attributable to the carrier after parcel handover;
- Misuse or improper maintenance of the Product by the Customer;
- Internet network malfunctions;
- Unforeseeable and insurmountable act of a third party.
ARTICLE 17 - CHARITABLE COMMITMENT, PARTNERSHIP WITH CHARITY: WATER
From 24 April 2026 to 31 December 2026 inclusive, LA SMOLE will donate €1.00 per Order placed on lasmole.com to Charity Global (UK) Limited (trading as charity: water UK), a charity registered in England and Wales under number 1169228, which will allocate 100% of donations received to clean water access projects.
This donation is borne entirely by LA SMOLE. It entails no additional cost for the Customer and gives rise to no tax benefit for the Customer.
The donation amount is fixed and independent of the number of Products in the Order. An Order cancelled or fully refunded within the 14-day legal withdrawal period does not give rise to a donation. A partial refund does not reduce the donation.

ARTICLE 18 - PERSONAL DATA
Personal data collected on the Site is processed in accordance with Regulation (EU) 2016/679 on data protection (GDPR) and French Act no. 78-17 of 6 January 1978 as amended.
The data collected (surname, first name, address, email, phone) is necessary for Order management and is only shared with third parties strictly to the extent necessary for Order execution (carriers, payment provider, shipping provider Sendcloud).
The Customer has a right of access, rectification, erasure, restriction of processing, portability and objection, exercisable by email at hello@lasmole.com. For more details, please refer to the Privacy Policy available on the Site.
ARTICLE 19 - INTELLECTUAL PROPERTY
All elements of the Site (texts, photographs, illustrations, logos, trademarks, software, graphic charter, patterns, designs) are protected by intellectual property law. Any reproduction, representation, modification or exploitation, in whole or in part, is prohibited without prior written authorisation from the Seller.
ARTICLE 20 - REGULATORY INFORMATION BY MARKET
20.1 Customers residing in the European Union (excluding France)
Customers residing in a European Union member state benefit from the mandatory provisions of the law of their country of residence when these provisions offer a higher level of protection than these Terms, in accordance with Regulation (EC) no. 593/2008 (Rome I), article 6.
20.2 Customers residing in the United Kingdom
Customers residing in the United Kingdom benefit from the rights provided by the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. The 14-day right of withdrawal applies under the conditions provided by British regulations. Customs duties and import taxes may apply upon receipt of the parcel.
20.3 Customers residing in Switzerland
Deliveries to Switzerland are subject to customs duties and Swiss import VAT. These costs are entirely at the Customer's expense. Customs clearance may cause additional delays.
20.4 Customers residing outside the EU, UK and Switzerland
International deliveries are subject to the customs and tax regulations of the destination country. All customs duties, import taxes and clearance fees are entirely at the Customer's expense. The Seller is unable to provide an estimate of these costs, which depend on the applicable local regulations.
ARTICLE 21 - DISPUTE MEDIATION
In case of dispute, the Customer is invited to first contact the Seller at hello@lasmole.com in order to seek an amicable solution.
In accordance with the provisions of the French Consumer Code on "the process of mediation of consumer disputes", after contacting the Seller and in the absence of a satisfactory response, the Customer has the option to use a consumer mediation procedure free of charge through:

ARTICLE 22 - GOVERNING LAW AND JURISDICTION
These Terms are governed by French law.
Any dispute relating to their interpretation or performance falls under the jurisdiction of the French courts. For customers residing in another European Union member state, the provisions of Regulation (EC) no. 593/2008 (Rome I) apply.
ARTICLE 23 - AMENDMENT OF THE TERMS
These Terms may be modified at any time. The applicable Terms are those in force on the date of the Order.
ARTICLE 24 - PARTIAL NULLITY
If any provision of these Terms is declared null or unenforceable, the other provisions shall remain in full force and effect.
